What is a Deed restricted Community?

A Deed Restricted Community has documented covenants/ restrictions along with rules & regulations that govern the use of the property within the community, no matter if they are owner occupied or rental/investment properties.  These governing documents help preserve the continuity in the community and ensure that the properties are properly maintained by keeping it attractive and desirable to homeowners. This helps maintain or increase the value in what, for many people is the largest and most important investment they own.

Florida law (720.401) requires the home seller or their agents in a deed restricted community notify homebuyers in writing that there are association covenants, rules and fees. The homebuyer signs this notification and acknowledges that they are aware of the governing documents. It is the responsibility of the homebuyer to examine the community’s governing documents to see how they or their tenants will be effected by the existing restrictions. When the purchase is complete, the new homeowner and or their tenants agree to abide by the governing documents of the HOA.
